Privacy & Terms, in plain language
Two documents live here: how we handle the data you send when you inquire, and the commercial terms that sit behind every quotation we issue. Both are written to be read, not skimmed past — if any clause is unclear, ask in the same email thread as your inquiry and the engineer who answers will clarify it before you order.

What we collect
When you submit an inquiry we collect the fields the form asks for: your name, company, work email, project type and message. If you write to us directly, we collect what your email contains. Our servers also keep basic request logs — pages requested, timestamps, coarse region — for the same reason most websites do.
How we use it
Inquiry data is used to prepare your quotation, follow up on the project, and produce the order and shipping documents if the project proceeds. A named engineer owns the correspondence; it is not handed to advertising lists or third-party marketers. If a project pauses, we keep the thread so it can resume without you re-explaining it.
What we never do
We do not sell, rent or trade your data. It is shared outside RackForge only where the order requires it — for example, your delivery address goes to the freight forwarder and, on DDP terms, to the customs broker acting for the shipment. Suppliers of accessory components see only the production information necessary to build your order, under the same confidentiality terms we sign with you.
Cookies and logs
This site uses only the basic, functional kind: session handling and anonymised traffic statistics. No advertising trackers, no cross-site profiling, no third-party ad pixels. Server logs are retained for a short operational window and then rotated.
Your choices and contact
You can ask what we hold about you, ask for corrections, or ask for deletion — write to sales@ems-rack.com from the address you inquired with and we will action it. The exception is records we must keep for a completed order: invoices, export declarations and the serial-matched warranty file, which exist for your protection as much as ours.
Terms of Sale
Quotations and validity
Every quotation is valid for 30 days from its issue date, which is printed on the sheet. After that, prices are re-confirmed against current steel and freight conditions before any order is accepted. A quotation becomes binding only through a signed order confirmation — not through email discussion alone.
Prices and trade terms
Prices are quoted on EXW or FOB Qingdao as the base, with CIF to a named port and DDP to door available on request; each term follows the Incoterms rule in force on the quotation date. Under FOB and EXW, import duties, taxes and destination charges are the buyer's account; under DDP they are included in the quoted price. Lead times are stated as production days after drawing sign-off and deposit, exclusive of ocean transit.
Drawings, layouts and confidentiality
Customer layouts and ODM drawings are protected by an NDA signed before they are shared, used only to manufacture that customer's orders, and returned or destroyed at project close on request. RackForge's own catalogue drawings, tooling and test data remain our property; a quotation or sample purchase does not transfer them.
Warranty
Structure and coating carry a 3-year warranty from bill-of-lading date; wear parts — hinges, locks, seals and brush strips — carry 1 year. The warranty covers defects in material and workmanship under normal service, and it is evidence-based: the serial number on the frame resolves to its factory test record, which is the reference for any claim. Remedies are repair or replacement of the affected part; consequential losses and site labour beyond the agreed scope are excluded. Wear from handling, overloading beyond rated static or dynamic limits, and unauthorised modification are not defects.
Governing law and dispute resolution
Orders are governed by the law stated on the order confirmation. If a dispute cannot be settled amicably within 30 days of being raised in writing, it is referred to final and binding arbitration — administered under rules agreed in the contract, in the seat stated there, in English — rather than to court litigation. Nothing in this clause prevents either party from seeking interim relief to protect goods in transit or payment in progress.
Changes to these terms
We may update this page as products, ports or regulations change; the effective date at the top of each document shows which version applies. Orders in progress are governed by the terms of the order confirmation they were signed against, and material changes are confirmed in writing before they affect a running project.
